2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. Promotion commences on 10/08/09 and closes at 11:59pm AEST on 14/09/09 (“Promotional Period”).
4. To unwrap the Virgin Blue present for the chance to win an Instant Prize, individuals must visit www.9thbirthdaysale.com.au and follow the instructions to unwrap the Virgin Blue present using the mouse cursor. Once the present has been unwrapped it will reveal a message advising the entrant whether they have won an Instant Prize. Entrants are only permitted to unwrap the Virgin Blue present for the chance to win an Instant Prize on one (1) occasion per day.
5. 6. Entrants will only be permitted to unwrap the Virgin Blue present on a maximum of two (2) occasions per day.
7. To be entered into the Major Prize Draw individuals must purchase airfares on any domestic flight flying Virgin Blue Airlines, either online or by phone, during the Promotional Period. Entrants will receive one (1) automatic entry into the Major Prize Draw upon completion of their transaction to purchase the flight. Only one (1) entry is permitted per person into the Major Prize Draw regardless of how many flights or seats on the same flight are purchased during the Promotional Period.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize.
11. Entries into the Major Prize draw close at 11:59pm AEST on 14/09/09. The Major Prize Draw will take place at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards NSW 2065 on 02/10/09 at 3:00pm AEST. The Major Prize winners will be notified by mail and their names will be published in The Australian on 09/10/09. Instant Prize winners will be notified immediately in writing via online notification and by email. All claims for Instant Prizes must be received by 08/01/10. The Promoter’s decision is final and no correspondence will be entered into.

13. Instant Prizes are to be awarded randomly during the Promotional Period. Winners of Instant Prizes will be required to provide their personal details including name, postal address and email address and Velocity number if they are a Velocity member at the time of winning notification so that their Instant Prize can be awarded.
14. All holidays to be awarded as instant prizes include two (2) return economy class airfares from the winners nearest capital city (if necessary) to their winning destination. Spending money, meals, taxes, insurance, passports, visas, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prizes must be taken by 14/03/2010 and are subject to booking and flight availability. Prizes cannot be taken during Australian or New Zealand school holidays, public holidays or peak periods.
15. Velocity Points can only be transferred to the winner's Velocity Membership Account when their valid Velocity Membership Number is provided. Winners must be or become a Velocity Member in order to claim the 5,000 Velocity Points prize, and must notify Velocity of their Membership Number within 30 days of winning. Winners will be contacted via email by Velocity to obtain their Membership Number if required. Points cannot be transferred into cash prizes. 16. All “Lounge” prizes including memberships and single entry pass prizes will require the winner’s Velocity membership number to redeem their prize. If the winner is not currently a Velocity member than they must become a Velocity Member in order to claim the “Lounge” prize, and notify Velocity of their Membership Number within 30 days of winning. Winners will be contacted via email by Velocity to obtain their Membership Number if required.
17. Any ancillary costs associated with redeeming the Virgin Blue gift voucher are not included. Any unused balance of the Virgin Blue gift voucher will not be awarded as cash. Redemption of the Virgin Blue gift voucher is subject to any terms and conditions of the issuer including those specified on the Virgin Blue gift voucher.
18. The first valid entry drawn from all entries received in the Major Prize Draw will win a trip for five (5) adults to Los Angeles, USA valued at up to AU$18,131.80 depending on date and point of departure. Prize includes return economy airfares for five (5) adults from winner's nearest capital city to Los Angeles-USA and five (5) nights minimum 4 star accommodation in two (2) rooms. Spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 01/06/2010 and is subject to booking and flight availability.
19. Frequent flyer points will not form part of any holiday prize. Holiday prizes are subject to the standard terms and conditions of individual prize and service providers. Winners of holiday prizes may be required to present credit card at time of accommodation check in.
20. If for any reason a winner does not take a prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. Total prize pool value is up to $67,864.80. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
23. A draw for any unclaimed Major Prize or Instant Win Prizes may take place on 11/01/10 at the same time and place as the original Major Prize Draw, subject to any directions from a regulatory authority. Winners’ names (for prizes over $250) will be published in The Australian on 18/01/10.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
26. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 439 instant online winning notifications for this promotion.
27. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
28. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter
